ShiftCare ("we," "our," or "us") operates an SMS-based shift management platform for licensed home care agencies. This Privacy Policy describes how we collect, use, and protect information, including mobile phone numbers and SMS opt-in consent data, in connection with our services.

2. Information We Collect

We collect the following categories of personal information:

• Contact information: Name, mobile phone number, ZIP code, email address
• Employment information: Certifications, availability, caregiver identification
• SMS consent data: Opt-in status, opt-in date, and source of consent
• Usage data: Shift records, clock-in/out timestamps, coverage history

3. SMS / Text Message Privacy — Mobile Data

All categories of personal data listed in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your personal data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

Specifically regarding mobile data:

• Mobile phone numbers collected through our service are used solely for operational shift notifications
• We do not sell mobile numbers to marketers, data brokers, or any third parties
• We do not share mobile numbers with affiliated companies for marketing purposes
• SMS opt-in consent data is kept confidential and used only to deliver the service you consented to

4. How We Use Information

We use the information we collect for the following purposes:

• Sending time-sensitive shift notifications to caregivers (cancellations, coverage requests, confirmations)
• Notifying family contacts of caregiver arrival updates for their loved ones
• Sending operational alerts to agency administrators
• Maintaining employment records and payroll calculations
• Providing access to the employee self-service portal

We do not use your information for marketing, advertising, or any purpose not directly related to delivering home care shift management services.

5. SMS Opt-In and Opt-Out

Caregivers provide opt-in consent during employment onboarding. Family contacts provide opt-in consent during service enrollment. All SMS recipients may opt out at any time by replying STOP to any message. Reply HELP for support information. Message and data rates may apply. Message frequency varies based on shift activity.

6. Data Sharing

We do not sell personal information. We may share information only in the following limited circumstances:

• Service providers: SMS delivery platforms (Telnyx), AI processing (Anthropic), and cloud hosting (Railway) — solely to provide our service
• Legal requirements: When required by law, court order, or governmental authority
• Business transfers: In the event of a merger, acquisition, or sale of assets, with advance notice to affected parties

We do not share personal data with third parties for their own marketing purposes.

7. Data Security

We protect personal data using industry-standard security measures including encrypted transmission (HTTPS/TLS), hashed password storage (PBKDF2-SHA256), and access controls. We retain shift and employment data for the period required by applicable labor laws.
